Welcome to The Gauntlet ("we," "our," or "us"). By downloading, accessing, or using The Gauntlet application, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
1. Description of Service
The Gauntlet is a gamified habit-tracking and productivity application that allows users to set goals, earn virtual rewards, interact with virtual digital items such as Pets, and purchase physical merchandise or premium digital services.
2. Virtual Currency ("Coins") and Digital Goods
- Nature of Virtual Currency: As you use the Service, you may earn, grind, or purchase virtual currency called Coins. Coins are digital content and represent a limited, non-transferable, revocable license to interact with certain features of the Service.
- No Real-World Value: Coins have no real-world monetary value and do not constitute real currency or property of any type. Coins cannot be sold, transferred, or exchanged for fiat currency such as USD with us or any third party.
- Expiration and Revocation: We reserve the right to manage, regulate, control, modify, or eliminate Coins, virtual pets, and digital inventory at our sole discretion. We are not liable to you or any third party for the exercise of such rights.
- Purchasing Coins: You may purchase Coin packs through the Service using real-world money via our third-party payment processor, Stripe. All purchases of virtual currency are final and non-refundable.
- Pet Care Grace Period: New users receive a 14-day grace period after signup where their pet does not need food or water.
- Pet Care Penalty: After the grace period ends, virtual pets must be fed and given water at least once every 7 days. If a pet becomes starving or dehydrated and your account has at least 500 Coins, it may automatically deduct 50 Coins every 24 hours to feed itself until care is restored.
3. Subscriptions ("Gauntlet Pro")
- Billing and Tiers: We offer premium subscription tiers, called Gauntlet Pro, on a monthly, annual, or one-time lifetime basis. By subscribing, you authorize us, via Stripe, to charge the applicable subscription fees to your chosen payment method.
- Auto-Renewal: Monthly and annual subscriptions automatically renew unless you cancel your subscription before the end of the current billing cycle.
- Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to Pro features until the end of your current paid billing period. We do not provide prorated refunds for partial subscription periods.
4. Physical E-Commerce Shop
- "Cash + Coins" Pricing: Certain physical merchandise in the Service may be purchased using a fixed combination of fiat currency and Coins. The required Coin amount must be available in your account balance to initiate the checkout process.
- Third-Party Fulfillment: Physical items may be fulfilled by third-party dropshipping partners. Shipping times, availability, and delivery are subject to the terms of these third-party providers.
- Refunds and Returns: Because physical purchases involve the expenditure of virtual Coins, all physical merchandise sales are considered final unless the item arrives damaged or defective. In the event of a valid refund for a defective item, fiat currency will be refunded via Stripe, and Coins will be credited back to your virtual wallet. Coins cannot be cashed out.
5. User Conduct and Verification
- Honor System and Spam: Free users operate on an honor system. Fake, joke, or spam goals created to exploit the Coin system are prohibited. We may delete those goals and apply a Coin penalty without warning.
- Verified Accountability (Pro Users): Gauntlet Pro users have access to Verified Accountability, requiring the upload of photographic proof. By uploading photos, you grant us permission to review these images strictly for verification purposes.
- Fraud Penalty: If you are a Pro user and submit fraudulent, misleading, or falsified proof, your goal will be marked as failed. Furthermore, we reserve the right to deduct a penalty, such as 500 Coins, from your virtual balance for defrauding the verification system. Your Coin balance may become negative as a result of penalties.
6. Health and Safety Disclaimer
The Gauntlet is a productivity tool, not a medical or health service. Any physical, dietary, or lifestyle goals you create, such as drinking water or exercising, are undertaken entirely at your own risk. You should consult with a qualified healthcare professional before beginning any new fitness or health regimen. We are not liable for any injury or damages resulting from goals you set within the app.
7. Account Termination
We reserve the right to suspend or terminate your account, discard your Coin balance, and revoke access to the Service at any time, with or without notice, if we determine that you have violated these Terms, engaged in cheating or exploiting the platform, or for any other reason at our sole discretion.
8. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the date at the top of this document or via in-app notification. Your continued use of the Service after changes are made constitutes your acceptance of the revised Terms.
